1. Acceptance of Terms & Global Platform Overview

By accessing or using the GETPWORKS INC. (operating as "PWORKS") application, website, and related services ("Platform"), you agree to these Terms of Service. PWORKS is a technology platform connecting independent service professionals ("Providers") with individuals or businesses seeking services ("Clients").

PWORKS operates, tests, and makes features available in multiple countries, regions, cities, currencies, and languages globally.

PWORKS IS A TECHNOLOGY INTERMEDIARY. WE DO NOT PROVIDE PROPERTY MAINTENANCE OR CLEANING SERVICES. WE DO NOT EMPLOY THE PROVIDERS. PWORKS ACTS SOLELY AS A MARKETPLACE TO FACILITATE CONNECTIONS AND PAYMENTS.

2. Global Availability & Platform Modifications

PWORKS features may vary significantly by country, region, and market. We may enable, disable, test, restrict, or modify features by country, region, city, service category, currency, payment availability, payout availability, or legal and compliance requirements.

Features that may vary include, but are not limited to:

• Account creation and address entry
• Service browsing and local service categories
• Pricing estimates and local currency display
• Live booking and payment processing
• Provider onboarding and provider payouts
• Tax estimates and supported languages

3. Automated Market Pricing Scanner & Estimates

PWORKS may use algorithms and automated tools to generate local service pricing estimates. Pricing shown in PWORKS may be an estimated local market rate generated using location, service type, timing, seasonality, provider availability, demand signals, available market data, fees, currency, and other relevant factors.

Final pricing may vary based on job details, provider acceptance, local conditions, taxes, fees, materials, travel distance, and market availability. Pricing estimates are not guaranteed final prices.

Pricing estimates are informational and market-based. Where required by law, users may request more information or human review if an automated decision produces a legal or similarly significant effect.

4. Currencies & International Configurations

Prices may display in local currencies and exchange rates may fluctuate. Currency conversions may be estimated, but the final checkout price controls if live payment is enabled.

Not all currencies, payment methods, or payment flows are available in every country. PWORKS may test currencies and pricing in specific markets without enabling live payments or live booking capabilities.

5. Payments by Market

Payments may be processed by Stripe or another third-party payment processor. Payment availability may vary by country, currency, payment method, and market configuration.

PWORKS may allow signup and pricing estimates even where live payments are not yet enabled. PWORKS may block or disable payment attempts for unsupported countries or currencies. PWORKS is not a bank, money transmitter, or financial institution.

6. Provider Payouts by Market

Provider onboarding and payouts may not be available in every country. Providers may be required to complete identity, tax, banking, or eligibility checks prior to receiving funds. Tax/payee setup may be completed after other onboarding and assignment-readiness steps where permitted by the applicable workflow; incomplete tax/payee information may block payout without by itself preventing assignment readiness.

For Canadian payees, a SIN is not used as identity verification. Where legally applicable, PWORKS may request a SIN, Business Number, or other appropriate tax identifier for payee and income reporting, including T4A preparation where applicable.

Payouts may be blocked, delayed, reversed, or disabled due to payment processor rules, fraud prevention, chargebacks, refunds, local law, or market configuration.

7. Local Law, Taxes, Licensing & Compliance

Users are responsible for complying with laws in their respective country or region. Providers are strictly responsible for maintaining required licenses, permits, insurance, safety requirements, tax reporting, and legal eligibility to work.

Clients are responsible for ensuring requested services are lawful and appropriate. PWORKS may restrict service categories by market. Providers are responsible for their own local tax, licensing, insurance, and legal obligations.

8. International Address & Location Integrity

Users must provide accurate country, address, and location information. Users may not misrepresent their location to access unavailable services, currencies, payments, or payouts. PWORKS may restrict or suspend accounts if location, payment, payout, or eligibility information is inaccurate, manipulated, or unsupported in your region.

9. Limitation of Liability

PWORKS disclaims all liability for any actions, errors, omissions, or negligence of Providers or Clients. PWORKS is not responsible for any property damage, personal injury, loss of life, or other damages arising from the physical delivery of services booked through the Platform.

In addition, PWORKS is strictly not liable for:

• Pricing estimate inaccuracies or differences
• Currency exchange fluctuations or conversion errors
• Unsupported payment methods or payment processor failures
• Payout restrictions, delays, or holds
• Tax estimate errors
• Provider or Client non-compliance with local, state, provincial, or national laws
• International market availability differences

10. Dispute Resolution: Arbitration & Class Action Waiver

Arbitration Agreement: To the extent permitted by applicable law, you and PWORKS agree that any dispute, claim, or controversy arising out of or relating to these Terms will be settled by binding individual arbitration, except that each party retains the right to bring an individual action in small claims court.

Class Action Waiver: TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PWORKS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11. Platform Fees and Marketplace Revenue

PWORKS may charge or retain platform fees for use of the marketplace, technology, payment support, booking coordination, customer support, platform maintenance, administrative operations, and related services. Platform fees are not broker commissions, real estate commissions, employment wages, referral commissions, or regulated transaction-based compensation unless expressly stated and legally permitted.

For real estate-related features, PWORKS provides software, profile, compliance vault, marketing, lead-intake, and communication tools only. PWORKS is not a real estate brokerage, does not represent buyers, sellers, landlords, or tenants, does not trade in real estate, does not collect real estate commissions, does not hold deposits or trust funds, and does not participate in offers, negotiations, closings, or representation agreements.
